Who is the Data Controller?
For what purposes do we process your personal data?
We process the provided personal data for the following purposes:
Comply with the duty to provide information and obtain the consents required by the new European legislation on the protection of personal data.
Manage the relationship with the client, generate quotes or commercial proposals and, if you become a client, engage in the contractual relationship on the provision of consulting services in various areas of regulatory compliance and legal advice, the relevant invoicing and charge for services. Providing data for this purpose is mandatory. Otherwise, the contract may not be fulfilled.
Sending newsletters, articles or news, information circulars written by our departments and related to our activity, unless you express your opposition by any means.
What data do we process?
Within the framework of the provision of the services we offer, and subject to the purposes agreed, our entity shall only process the data strictly necessary for the proper management of the contractual relationship and/or provision of services, and shall be exclusively the data provided.
How long shall we process your data?
The personal data shall be stored for as long as the current contractual/commercial relationship is in force, or for a period of five years from the last business relationship, in accordance with the regulation for tax purposes. However, our entity shall continue to keep your information for the purpose of sending potential marketing communications that we consider to be of interest to you, as long as the interested party does not request its erasure. Data subjects can always exercise their rights under current legislation by contacting us via the most convenient means, as explained below.
What is the legitimacy for data processing?
The legal basis for the processing of your data is the fulfilment of the service contract necessary for the execution of the business transaction, or this legitimacy is granted by your express consent as your own and primary interested party.
To whom shall data be sent?
Data shall not be communicated to any third party not related to the provision of the service, except for legal obligations in force. In the event that this circumstance changes, you will be duly informed, requesting your consent for said transfer. Please note that no international transfers shall be made either.
However, we inform that, for the correct provision of services, it is possible that different service providers contracted by our company (data processors) may have access to the personal information necessary to perform their functions.
These services provided by third parties are necessary for the development of our activity and the provision of the service and, at all times, the data processing they carry out is governed by a contract that binds the manager to our entity. Under no circumstances they shall use the information for other purposes, and they shall process it in accordance with the guidelines stipulated by our entity, in accordance with our privacy policy and current legislation on data protection.
Our company, in its commitment to privacy and protection of the User’s data, shall only choose service providers that offer enough guarantees to apply appropriate technical and organisational measures, so that the processing is in accordance with the applicable legislation on data protection and guarantee the protection of the User’s rights.
What are your rights when you provide us with your data?
Anyone has the right to obtain confirmation as to whether or not we are processing personal data concerning them. In this regard, they have the right to require:
Access: The data subject shall have the right to obtain confirmation from the controller as to whether or not the data concerning them is being processed, as well as detailed information on certain aspects of the processing being carried out.
Rectification: The data subject shall have the right to obtain the rectification of inaccurate personal data concerning them or the completion of incomplete personal data.
Erasure: The data subject shall have the right to request the deletion of their personal data. In any case the erasure shall be subject to the limits laid down in the regulatory law.
Restriction of processing: The data subject shall have the right to request a limitation on the processing of their personal data.
Opposition to processing: In certain circumstances and due to their particular situation, data subjects may object to the processing of their data. The entity will cease processing the data, except for legitimate, compelling reasons, or the exercise or defence of possible claims.
Right to data portability: That is to say, they have the right to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format and to transmit them to another controller.
They may exercise these rights by contacting the responsible party. To do this, they may use the contact details provided at the beginning of this document. If they wish to obtain additional information regarding the exercise of their rights, they may also contact the Spanish Data Protection Agency.
We also inform that, if applicable, they have the right to withdraw, at any time, the consent granted for a specific purpose, without affecting the lawfulness of the processing, based on the consent prior to its withdrawal.
